A bail bond (or bonds) is a document that guarantees someone’s release from custody while they await trial.
- The judge sets the bail amount, and you have two alternatives for meeting that requirement. One option is to pay the entire bail money in cash at the jail. The other option is to hire a bail bondsman who will charge you a fee determined by the state; the fee schedule is as follows: any bond under $1,000 will cost you $100, and any bond over $1,001 will cost you 10% of the bond. As an example, a bail bondsman charged $100 for a $500 bond and $5,000 for a $5,000 bond.
One of the main benefits of utilizing a bail bondsman is that, unlike paying cash to the jail, you know exactly how much it will cost to get the bond(s) posted.
- If you pay the cash to the jail, they will pass it on to the court, who will keep it in escrow. The court will deduct all court costs, fines, and fees from the total and reimburse the difference once the matter is over. A $5,000 cash bail posted at the jail, for example, would go to the court’s escrow account until the case was completed. Now they would deduct $300 in court costs, $2,500 in fines, and $150 in fees from your $5,000 and refund $2,050 to you, whereas the $5,000 bond with the bondsman will cost $500.
Indemnitor
- The indemnitor, also known as a co-signer, is the person who assumes financial responsibility for the bond if the defendant fails to appear in court and the case is not resolved within the time frame provided by state statute 903.26 and the court.
The fee for the posted bail bond(s) is non-refundable.
- Unless the bail bond(s) is forfeited, any other collateral will be refunded once the case is finished. The collateral will be converted to cash and handed over to the courts at that point. The only method to reclaim it is to have the forfeited bond(s) fixed and have the court grant remission, as outlined in Florida Statute 903.28.
